AG REILLY SUES MAGNETIC MATTRESS SELLER ACCUSED OF DENYING CONSUMER REFUNDS

Attorney General Tom Reilly is seeking about $31,000 in refunds for Massachusetts consumers, many of them senior citizens, who bought magnetic mattresses pads from a Florida-based seller and then were unable to return them during the company's 100-day, no-risk trial period.

In a lawsuit filed today in Suffolk Superior Court, AG Reilly alleges that European Health Concepts, 1711 Worthington Road, West Palm Beach, violated the Massachusetts Consumer Protection Act by knowingly and willingly failed to meet the terms of the product warranty.

Companies cannot make promises that they do not keep, AG Reilly said. My Office will make every effort to get refunds to these consumers who were hurt by this company.

Since 2000, EHC marketed and sold specialized mattress pads called magnetic sleep systems and cushions, priced at more than $750 each, at sales presentations held at area restaurants in Massachusetts, according to the complaint. EHC used mass mailings, primarily targeted at senior citizens, which advertised a free meal along with the sales presentation.

At these presentations, EHC sales representatives allegedly claimed that the product included a warranty for a free, no-risk 100 day trial period. If the buyer was not satisfied after 100 days, he or she could get a full refund by contacting EHC and returning the mattress pads.

AG Reilly, however, alleges in the complaint that EHC failed to provide full refunds as promised to 28 Massachusetts consumers, all of whom called within the company's advertised 100-day warranty period.

AG Reilly was alerted to the case when a number of individuals called the Attorney General's Elder Hotline to register complaints about EHC. These individuals claimed that they returned, or tried to return, their mattress pads and were denied a refund.
